‘A 50/50 Chance’: State Farm Asks for Summary Judgment on Bad Faith Before the Hursh Hail Trial
State Farm’s motion for partial summary judgment in Hursh v. State Farm argues that the homeowners’ own report of a ’50/50 chance’ proves a ‘legitimate dispute’ that bars their bad-faith, punitive-damages and fraud claims. The Oct. 15 version left 24 paragraph numbers as ‘#’ and one ‘[CITE]’; State Farm refiled it Oct. 19. Trial is set for Dec. 7.
